For Photography & Film Services

1. Private Use – Photography & Film

This applies to commissioned material for personal use, such as portraits or private events.

The agreed price includes the right to use delivered photos and/or films for private, non-commercial purposes.
If published on social media, credit to the photographer (e.g. "Photo by imative.co") is required.
For any usage outside personal/private context, the photographer must be contacted in advance for permission. Additional licensing fees may apply.

The agreed price includes the right to use the film as defined in the project agreement or quote.
Any extended or repeated use (e.g. repurposing content for a new campaign) requires a new license. A reuse fee starting at 50% of the original fee applies.
Third-party use (by partners, agencies, affiliates, etc.) requires prior written consent and may incur additional charges.

The agreed price includes the right to use photos as defined in the project agreement.
Extended use, reuse, or transfer of usage rights requires the photographer’s written approval and may result in additional charges.
For broad internal use across the client’s business, an extended license fee of 50% of the base fee applies.
A broad usage license does not transfer ownership. The client is not permitted to resell, distribute, or sublicense the images without written permission.

Image/Video Selection: The photographer selects the final material to be delivered based on quality and consistency.
Approval of Deliverables: The client is responsible for reviewing delivered materials without undue delay. Once material is used, it is considered approved.
Usage Rights: Images and videos may only be used in the scope agreed upon at the time of booking. All other uses require written permission. Usage rights may not be transferred to third parties without prior consent.
Exclusive Use: Exclusive rights must be explicitly agreed upon in writing. Standard projects are delivered under non-exclusive licenses.
Photographer’s Own Use: Unless otherwise agreed, the photographer retains the right to use images and videos for portfolio, exhibitions, marketing, or publication.
Reproduction & Alteration: The original visual style must be respected. Altering, manipulating, or transforming the material into other forms of art requires written permission.
Credit: Photographer credit must be given when images or films are published, unless otherwise agreed.
Metadata: No metadata may be removed or altered without consent from the photographer.

Items Provided for Photography: The client is responsible for ensuring that any objects provided for the shoot are adequately insured. The photographer is not liable for damage or loss of such items.
Budget Responsibility: If the client requests changes or additions during production that lead to increased costs, those additional costs will be invoiced accordingly.
Portraits Featuring People: For images or videos featuring identifiable individuals, the client is responsible for obtaining any necessary consent or model releases under applicable law, particularly for commercial or online use.

The agreed fee is invoiced and due within 30 days of the invoice date.
VAT (25%) is added to all prices unless otherwise stated.
In case of delayed payment, an 8% late payment interest applies, along with a reminder fee.
